Mediation

Mediation is a process in which the parties to a dispute, assisted by an impartial, licensed third party — the mediator — reach a solution acceptable to both. It is governed by Albanian Law no. 10 385 of 24.2.2011 "On mediation in the resolution of disputes" and can be used before or during court proceedings.

Why mediation?

  • Time: many matters are resolved within about 30 days, while court cases often last for years.
  • Cost: expenses are several times lower than litigation.
  • Choice: the parties choose their mediator, unlike court where judges are assigned by lot.
  • Both parties win: the solution is built together, so the dispute ends and relationships are preserved.
  • Confidentiality: discussions during mediation are private.
  • Legal force: a mediation agreement approved by the court is an enforceable title with the same force as a judgment.

Areas

  • Commercial disputes: capital increases or reductions, shareholders and quotas, disputes between companies.
  • Civil property disputes: ownership and possession, bilateral contracts (sale, construction, lease, insurance), co-ownership partition, moral or material damages.
  • Family matters: child support, care and education, parental responsibility, contact with children, post-divorce property and housing rights.

Mediated divorce — even if you live abroad

If you are about to divorce but live outside Albania, the mediator can help you settle the divorce and its consequences (children, maintenance, property) by agreement, without needing to appear in person at every stage.

How it works

  1. Initial consultation
  2. Neutral invitation to the other party
  3. Mediation sessions
  4. Signing the mediation agreement
  5. Court approval (homologation), where required
